{"id":7043,"date":"2026-10-08T19:17:41","date_gmt":"2026-10-08T22:17:41","guid":{"rendered":"https:\/\/jornalfax.net\/?p=7043"},"modified":"2026-10-08T19:17:43","modified_gmt":"2026-10-08T22:17:43","slug":"cpj-alerta-para-pressao-judicial-sobre-jornalistas-angolanos-antes-das-eleicoes-de-2027","status":"publish","type":"post","link":"https:\/\/jornalfax.net\/index.php\/2026\/10\/08\/cpj-alerta-para-pressao-judicial-sobre-jornalistas-angolanos-antes-das-eleicoes-de-2027\/","title":{"rendered":"CPJ ALERTA PARA PRESS\u00c3O JUDICIAL SOBRE JORNALISTAS ANGOLANOS ANTES DAS ELEI\u00c7\u00d5ES DE 2027"},"content":{"rendered":"\n<p>Dezenas de jornalistas angolanos continuam a enfrentar processos e investiga\u00e7\u00f5es por difama\u00e7\u00e3o criminal, numa altura em que o pa\u00eds se aproxima das elei\u00e7\u00f5es gerais previstas para 2027, segundo um levantamento do <a href=\"https:\/\/cpj.org\/pt\/2026\/10\/ameaca-de-difamacao-criminal-paira-sobre-dezenas-de-jornalistas-angolanos-na-vespera-das-eleicoes-de-2027\/\" target=\"_blank\" rel=\"noreferrer noopener\">Comit\u00e9 para a Protec\u00e7\u00e3o dos Jornalistas<\/a> (CPJ).<\/p>\n\n\n\n<p>A organiza\u00e7\u00e3o afirma ter entrevistado 38 jornalistas angolanos que, desde 2015, foram alvo de investiga\u00e7\u00f5es por difama\u00e7\u00e3o criminal. No conjunto, estes profissionais ter\u00e3o enfrentado mais de 200 processos ou investiga\u00e7\u00f5es relacionados com este tipo de crime.<\/p>\n\n\n\n<p>O caso do jornalista Daniel Frederico \u00e9 apresentado pelo CPJ como um dos exemplos mais recentes. A viver no ex\u00edlio, Frederico foi condenado, em 2 de Outubro, a 14 meses de pris\u00e3o, num processo relacionado com uma reportagem publicada em 2022 por outro \u00f3rg\u00e3o de comunica\u00e7\u00e3o social. Segundo o CPJ, a senten\u00e7a foi proferida na aus\u00eancia do jornalista, que recorreu da decis\u00e3o.<\/p>\n\n\n\n<p>O jornalista afirma que deixou Angola em 2025 por recear ser detido na sequ\u00eancia de um processo de difama\u00e7\u00e3o. O seu advogado, Ant\u00f3nio Martins, considera a condena\u00e7\u00e3o injusta e sustenta que Frederico apenas procurou obter a vers\u00e3o de uma pessoa mencionada na reportagem.<\/p>\n\n\n\n<p>Processos envolvendo jornalistas<\/p>\n\n\n\n<p>De acordo com o CPJ, apenas um dos 38 jornalistas entrevistados cumpriu pena de pris\u00e3o na \u00faltima d\u00e9cada. Outros seis foram absolvidos ou tiveram os respectivos processos arquivados, enquanto 31 continuam com processos em curso.<\/p>\n\n\n\n<p>Entre os casos mencionados pela organiza\u00e7\u00e3o est\u00e3o jornalistas de diferentes \u00f3rg\u00e3os de comunica\u00e7\u00e3o social, incluindo publica\u00e7\u00f5es digitais e r\u00e1dios.<\/p>\n\n\n\n<p>O CPJ cita ainda o jornalista Escriv\u00e3o Jos\u00e9, editor do jornal online Hora H, que afirma ter enfrentado 32 investiga\u00e7\u00f5es por difama\u00e7\u00e3o ao longo de 16 anos. Segundo o jornalista, os processos representam custos financeiros e um desgaste significativo para os profissionais.<\/p>\n\n\n\n<p>O levantamento inclui igualmente casos recentes, como o do jornalista Isidro Kangandjo, editor do Factos Di\u00e1rios, que, segundo o CPJ, foi detido em Setembro juntamente com um operador de c\u00e2mara quando se dirigia \u00e0 administra\u00e7\u00e3o municipal de Calumbo para procurar uma reac\u00e7\u00e3o a alega\u00e7\u00f5es publicadas pelo \u00f3rg\u00e3o.<\/p>\n\n\n\n<p>A administra\u00e7\u00e3o municipal afirmou posteriormente que a reportagem era falsa e que a deten\u00e7\u00e3o ocorreu depois de uma queixa apresentada \u00e0 Pol\u00edcia. Os jornalistas foram libertados no dia seguinte, sem acusa\u00e7\u00e3o, segundo o CPJ.<\/p>\n\n\n\n<p>Autoridades defendem procedimentos legais<\/p>\n\n\n\n<p>O Minist\u00e9rio do Interior disse ao CPJ, em nome do Servi\u00e7o de Investiga\u00e7\u00e3o Criminal (SIC), que os processos correspondem a procedimentos legais normais e que qualquer pessoa que se considere lesada pode recorrer aos mecanismos judiciais.<\/p>\n\n\n\n<p>O Minist\u00e9rio P\u00fablico, por sua vez, afirmou que tem obriga\u00e7\u00e3o de investigar os casos encaminhados pelo SIC. Marty Kanando, porta-voz da Procuradoria-Geral da Rep\u00fablica, disse ao CPJ que cabe ao legislador determinar se determinadas condutas devem ser tratadas como crimes.<\/p>\n\n\n\n<p>A legisla\u00e7\u00e3o angolana prev\u00ea actualmente o crime de difama\u00e7\u00e3o. O C\u00f3digo Penal estabelece, no artigo 214.\u00ba, pena de pris\u00e3o at\u00e9 um ano ou multa at\u00e9 120 dias, podendo a pena atingir entre seis e 18 meses de pris\u00e3o em determinadas circunst\u00e2ncias relacionadas com discrimina\u00e7\u00e3o. A lei prev\u00ea tamb\u00e9m situa\u00e7\u00f5es em que a imputa\u00e7\u00e3o de factos n\u00e3o \u00e9 pun\u00edvel, nomeadamente quando \u00e9 feita para realizar interesses leg\u00edtimos e existem condi\u00e7\u00f5es previstas no pr\u00f3prio diploma.<\/p>\n\n\n\n<p>Preocupa\u00e7\u00f5es antes das elei\u00e7\u00f5es<\/p>\n\n\n\n<p>O CPJ considera que o recurso a processos criminais por difama\u00e7\u00e3o pode produzir um efeito de intimida\u00e7\u00e3o sobre jornalistas, sobretudo quando as investiga\u00e7\u00f5es envolvem reportagens sobre alegadas irregularidades de respons\u00e1veis p\u00fablicos, for\u00e7as de seguran\u00e7a ou figuras com influ\u00eancia pol\u00edtica e econ\u00f3mica.<\/p>\n\n\n\n<p>V\u00e1rios jornalistas entrevistados pela organiza\u00e7\u00e3o afirmaram que os processos foram utilizados para tentar impedir a publica\u00e7\u00e3o ou circula\u00e7\u00e3o de informa\u00e7\u00f5es consideradas sens\u00edveis.<\/p>\n\n\n\n<p>O jornalista e advogado Teixeira C\u00e2ndido disse ao CPJ que os processos podem ser utilizados como instrumento de intimida\u00e7\u00e3o contra profissionais que investigam figuras com poder.<\/p>\n\n\n\n<p>A organiza\u00e7\u00e3o cita ainda a Comiss\u00e3o Africana dos Direitos Humanos e dos Povos, que tem defendido a revis\u00e3o das leis penais de difama\u00e7\u00e3o e a prefer\u00eancia por san\u00e7\u00f5es de natureza civil.<\/p>\n\n\n\n<p>O CPJ afirma que n\u00e3o existem dados oficiais sobre o n\u00famero total de jornalistas investigados por difama\u00e7\u00e3o criminal em Angola.<\/p>\n\n\n\n<p>Com as elei\u00e7\u00f5es gerais previstas para 2027, a organiza\u00e7\u00e3o considera que a situa\u00e7\u00e3o merece particular aten\u00e7\u00e3o, sobretudo devido ao papel dos meios de comunica\u00e7\u00e3o social na divulga\u00e7\u00e3o de informa\u00e7\u00f5es e no escrut\u00ednio p\u00fablico.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dezenas de jornalistas angolanos continuam a enfrentar processos e investiga\u00e7\u00f5es por difama\u00e7\u00e3o criminal, numa altura em que o pa\u00eds se aproxima das elei\u00e7\u00f5es gerais previstas para 2027, segundo um levantamento do Comit\u00e9 para a Protec\u00e7\u00e3o dos Jornalistas (CPJ).
